BioVault Terms of Use
These Terms of Use ("Terms") govern your use of the BioVault mobile and desktop applications ("BioVault," "the App"), published by Aram Khudaverdyan ("we," "us," "the developer"). By downloading, installing, or using BioVault, you agree to these Terms. If you don't agree, don't use the App.
This document covers your legal relationship with us. For what data BioVault does (and doesn't) collect, see the Privacy Policy — the short version is: none.
1. What BioVault is
BioVault encrypts photos, videos, and documents you choose to import, using advanced encryption, and stores them only in the App's private storage on your own device(s). Access is gated by your device's biometric authentication or, on a device with none enrolled, a PIN you set yourself. BioVault runs entirely on-device — there is no BioVault server, account, or cloud service of any kind.
2. License
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to use BioVault on devices you own or control, for your own personal use. You may not: reverse-engineer, decompile, or attempt to derive the source code of the App except where applicable law expressly permits it; resell, rent, lease, or sublicense the App; use the App for any unlawful purpose, or to store or transmit content you don't have the right to possess; or attempt to circumvent, disable, or interfere with the App's security features.
3. Your content
You retain full ownership of every file you import into BioVault. We never see, access, or have any ability to access your files or their contents — they're encrypted on your device before we, or anyone else, could look at them, and the decryption key never leaves your device's secure hardware. You're solely responsible for the legality of the content you store in the App and for complying with any laws that apply to it.
4. BioVault Premium (in-app purchase)
BioVault's free plan supports up to 10 files in your vault. BioVault Premium is an optional, one-time, non-consumable purchase that removes that cap for unlimited vault files. It is not a subscription — it does not renew, expire, or charge you again. Every other feature of the app (device-to-device transfer, streaming a file to a nearby device, and unlocking a paired computer with your phone) is free for every user, whether or not Premium is purchased.
- Premium is billed and processed entirely by Apple (App Store) or Google (Play Store) depending on your platform — we never see or handle your payment details.
- Your purchase is tied to your Apple ID or Google account and can be restored on a new device or after reinstalling the App via the "Restore Purchases" option in Settings, at no extra charge.
- Refunds are handled entirely by Apple or Google under their own refund policies — we have no ability to issue, approve, or deny a refund ourselves. Contact Apple Support or Google Play Support directly for a refund request.
5. No cloud backup — data loss is permanent and irreversible
BioVault deliberately has no cloud backup, cloud sync, or key-recovery mechanism of any kind. The encryption key protecting your vault exists only in that device's secure hardware (Secure Enclave / Android Keystore / TPM), gated by your biometric or PIN. If you lose the device, factory-reset it, uninstall the App, or otherwise lose access to that key, the files inside your vault cannot be recovered by you, by us, or by anyone else — including through customer support. This is a deliberate design trade-off, not a bug: it's what makes it true that nothing about your files can ever leave your device. BioVault warns you about this the first time you use it, and by using the App you acknowledge and accept this risk.
6. Disclaimer of warranties
BioVault is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the App will be uninterrupted, error-free, or immune from vulnerabilities, or that it will meet your specific requirements. No advice or information you obtain from us creates any warranty not expressly stated in these Terms.
7. Limitation of liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, files, profits, or goodwill, arising from your use of (or inability to use) BioVault — including, specifically, loss of files due to the no-recovery design described in Section 5. Where liability cannot be excluded under applicable law, our total liability is limited to the amount you paid us in the twelve months before the claim arose (i.e., the price of BioVault Premium, if purchased, or $0 if you never purchased it).
Nothing in these Terms limits any liability that cannot be limited under applicable law, and nothing here affects statutory rights you may have as a consumer that cannot be waived by contract.
8. Termination
You may stop using BioVault at any time by uninstalling it. We may suspend or terminate your license to use the App if you materially breach these Terms. Section 5 (no cloud backup), 6 (warranty disclaimer), and 7 (limitation of liability) survive any termination.
9. Changes to these Terms
We may update these Terms from time to time. If we do, we'll publish the revised version at the same URL this document is hosted at, with an updated "Last updated" date above. Continuing to use BioVault after a change takes effect means you accept the revised Terms.
10. Apple-specific terms
If you downloaded BioVault from the Apple App Store, the following additional terms apply and take precedence over any conflicting term above, per Apple's required minimum terms for third-party app EULAs:
- This license is limited to a non-transferable license to use BioVault on an Apple-branded product that you own or control, as permitted by the App Store's Usage Rules.
- Apple has no obligation whatsoever to furnish any maintenance or support services for BioVault.
- In the event of any failure of BioVault to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for BioVault to you; to the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to BioVault, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are our sole responsibility, as set out in these Terms.
- Apple is not responsible for addressing any claims by you or any third party relating to BioVault or your possession and/or use of it, including (but not limited to) product liability claims, any claim that BioVault fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- In the event of any third-party claim that BioVault, or your possession and use of it, infringes that third party's intellectual property rights, we (not Apple) are solely responsible for the investigation, defense, settlement, and discharge of any such claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
